These Terms cover shantimindflow.com and current and future ShantiMindflow websites, subdomains, education products, and invited accounts. If a signed order or master agreement exists, that writing controls if it conflicts with these Terms.
You accept these Terms and the Privacy Policy when you click Agree, check a consent box, create an invited account, sign in, or otherwise use the services. If you act for an institution, you confirm you may bind that institution.
1. Education products, not medical services
We provide motion, communication, attention-training, and related interactive systems for education, sports, and venues, on an invited basis. Website descriptions are not a warranty that every feature is on for every partner.
The services are for learning, practice, assessment support, and institutional operations. They are not medical devices and do not diagnose, treat, or replace professional care. EEG, AAC, and similar tools described here are educational or assistive communication systems in that sense.
Use with children or adolescents must be supervised by guardians and qualified institutional staff, in accordance with applicable law. The public website is for adults and institutions, not for children to operate on their own.
2. Your responsibilities
You are responsible for invited accounts, content you submit, and for complying with laws that apply to your site—including privacy rules, notices to families, and how sessions are run in classrooms or venues. We are not your lawyer, ethics board, or medical adviser.
AI features on the website or in a product may draft answers that are incomplete or wrong. A person on your side must review anything that will be shown to learners, families, or the public before it is relied on, unless we have agreed otherwise in writing.
3. Use limits
Do not probe or disrupt the services, bypass access controls, upload malware, impersonate others, or use the services for unlawful activity. We may suspend an account to protect the platform, other partners, or to enforce these Terms.
4. Liability
To the maximum extent permitted by law, ShantiMindflow has no obligation to pay compensation, damages, or refunds because you used the websites or products. We are not liable for lost data, lost business, or any indirect loss. If you have a signed paid contract with us, that contract governs. Nothing here limits liability that mandatory law does not allow us to exclude.
You will indemnify ShantiMindflow against claims arising from your content, your on-site use with learners, or your violation of law or these Terms, except to the extent caused by our willful misconduct.
5. Law
These Terms are governed by the laws of Quebec and the federal laws of Canada applicable there. Courts in Montreal, Quebec have exclusive jurisdiction, except that we may seek injunctive relief elsewhere to protect the platform. We may update these Terms by posting a new version on this page.
